Preamble
The following general terms of sale (here in after “general terms of sale” or “CGV”) regulate the sale and purchase of the products (here in after “the Products”) offered by Mobilificio Marchese (here in after “the Seller”), registered office at Via Giordano Bruno 148, Messina 98123, P.IVA 00194590832, through the website www.mobilificiomarchese.it and/or www.mobilificiomarchese.com (here in after “the website”) to the website users (here in after “the client” or “the clients”).
This general terms of sale are governed by the Italian Law and in particular, by Decreto Legislativo 6 settembre 2005, n. 206 ("Codice del Consumo" sezione II artt.50-67) and by Decreto Legislativo 9 aprile 2003, n. 70 (here in after, "Decreto E-commerce"). All of the informations in the website are in Italian and English languages. The customer declares to have read all the above information and general conditions of sale before placing the order. The customer declares to have the legal capacity to engage as provided in these general terms of sale. The CGV, which are an integral part of the present conditions, will remain effective until changed by the Seller, and any changes will be effective from the moment they are published on the website and will refer to sales made from that moment on.
1. Acceptance of Terms and Conditions of Sale
The customer, with his purchase order, unconditionally accepts and agrees to observe in its dealings with Mobilificio Marchese srl, the general conditions and the conditions of payment described below, claiming to have read and accepted all the information provided to him . The Customer shall purchase products by consulting the descriptive and technical files available on the site and is therefore solely responsible for the choice and the suitability of the product for the purpose.
2. Informations related to products
The products with the prices and codes, photos and details, are available on the website, and represent a public offer, the terms of which apply only to purchases made on the website. For each product will also be indicated in the data sheet the designer he designed it and the company/ies that has/have made it. Also highlighted will be the time estimated for delivery f the product, mainly due to the time required for the handicraft production. The product purchased may vary from the pictures published in the product file on the website.
3. Prices
All the selling prices of the products published on the website are stated in Euros and include VAT. Mobilificio Marchese srl has the right to change the selling price at its sole intention at any time. The price changes have no effect on orders that the customer has already submitted. To the Products will be applied the price visible and highlighted on the website at the time of order. The purchase price thus established is fixed and definitive. It does not include the delivery costs charged separately, that will be indicated in the order confirmation. In case of delivery abroad will be charged by the Customer any additional costs due to taxes or fees provided by law in the State of destination. The customer is solely responsible for verifying the possibility of importing the products ordered with respect to the law of the related country. Also, customs fees are to be paid by the client.
4. Payment method
The customer who intends to purchase the products must manifest this will through a request made directly on the website, in the specific dedicated section, where, following the procedures described above, he will send the purchase order and make the payment. The payment of the price is due from the time of order. In case of non-receipt of payment, Mobilificio Marchese reserves the right to cancel the order. The customer agrees to pay the agreed price for the product ordered on the website (price of the product and transportation) with the available payment methods: Paypal, credit card or bank transfer.
We accept main Credit Cards: Visa, Visa Electron, Mastercard, Maestro, American Express and Diners. All credit card transactions on Mobilificio Marchese are processed through the security system X-Pay Visa, the global leader in credit card industry. It allows to process any type of credit card with an SSL encrypted at 128 bits. Once you will choose this method of payment you will be transferred to the platform X-Pay and your card data will be managed by Visa. Mobilificio marchese and its employees never know or store your credit card numbers. Mobilificio Marchese also allows payment via Paypal, world's leading platform for online payments and cutting edge in terms of safety. We don't apply any Paypal commission if Paypal payment is allowed on your country. If you choose to pay by Bank Transfer, website show you a page with our bank account and details. In case of payment by bank transfer the customer has 48 hours of time since completion of the order to make the bank transfer as described in the order confirmation page. If the transfer is not made within that period or not credit to the account of Mobilificio Marchese srl indicated within 10 days, the Seller reserves the right to cancel the order. Orders placed by bank transfer will in any case be processed and / or put into production only after the actual receipt of the payment and the delivery times estimated as of that date. For Bank Transfer payment the order is finalized only when we receive the payment on our bank account.
5. Confirmation of received order
The Client correctly concludes the Order Procedure if the website does not show any error message. For the buyer, the order is concluded at the time of confirmation of purchase on the website, while the Seller instead the order is effective upon receipt of payment. Mobilificio Marchese srl shall give the confirmation by sending an e-mail of confirmation of the order (the "Order Confirmation") to the email address supplied by the customer. This Confirmation will summarize the selected products, their prices include the cost of delivery, the delivery address, the order number (the "Order Number"). The Customer undertakes to verify the correctness of the data contained in the Order Confirmation and notify the Mobilificio Marchese corrections. Possible worsening of certain expenses given by data errors will be charged to the customer. The Number of the Order, generated by the system and communicated by Mobilificio Marchese srl will be used by the customer in any communication with the Seller. It is recommended to print and keep the email receipt as proof of purchase or store it in a durable support. If the customer wishes to receive a document valid for tax purposes, it can be requested by sending an email following the order. In this case, the customer also agrees to provide accurate information necessary for billing.
6. Transportation and Delivery
Through the website the client can check in advance the countries where Mobilificio Marchese is able to ship the products and the related cost of shipping. For our shipping we rely on services of Couriers specialized in the delivery of furniture and fittings to ensure the quality of the service and the integrity of the products. Unless otherwise requested by the customer the delivery of the product is intended at the front street. Carriage does not include the delivery to the plan, the assembly of the product, and the disposal of packaging. In any case it is responsibility of the customer to verify that the size of the purchased product is compatible with the space in which he wants to place and that it is possible to make the delivery in an easy manner to the conveyor, in the case of delivery to the plan that the product steps for the stairway or the elevator and in any doors. Any additional cost to enable the placement is charged to the customer.
All of our items are shipped with insurance. For the delivery of the goods is necessary the presence of Customer or its representative at the address indicated in the order. In case of absence of the recipient during the delivery, the courier will leave a notice to the address indicated by the customer. The products must be collected at the address and in the manner specified by the carrier. If not collected within the period specified by the courier, the products will be returned to Mobilificio Marchese. In this case the customer will not be entitled to any refund. The carriage costs of returning products Mobilificio Marchese srl will be charged to the customer. Upon delivery of the goods by the Courier, the Customer must check that the number of boxes is the same as indicated in the transportation document, and that the package is intact or altered. The delivery note with the date and signature of the customer is a document that certifies the successful delivery. Any damage to the parcel marginal and / or products or the mismatch in the number of packages must be immediately notified via reserve check written on the Courier delivery note. By signing the delivery note of the courier, the Customer declares that the goods received is intact. Mobilificio Marchese srl can not be held liable for non-delivery or damage to or defects in products delivered due to force majeure.
For orders purchased from the 1st of August to the 31st of August, the availability time has to be considered starting from the first week of September.
During the month of August companies will be closed for the summer holidays and the production process will be delayed.
7. Returns
The consumer has the right to withdraw from any distance contract without any penalty and without giving any reason, within 10 working days from order (note: The order shall be deemed completed upon receipt of the payment of the product/s), or from the day of delivery to the client. The right of withdrawal must be exercised by the customer, subject to revocation, by registered letter return receipt to Mobilificio Marchese srl, Via Giordano Bruno 148, 98123 Messina, in advance by mail shop@mobilificiomarchese.it. You can not demand rescission for "made to order" products that will be indicated as such on the website. All returns, which must be undamaged, they must be authorized by Customer Service. The product must be returned in its original packaging. It must not have been used, nor have suffered damage even the minimum and be in a state of perfect cleaning. Once authorized the return, the Customer Service will also indicate the address to which to send the product. They will not accept parcels on delivery. After receiving the Products (and verified their integrity) Mobilificio Marchese will, as soon as possible, within 30 days, refund to Customer the amounts paid. For this, the client will inform the customer service about his bank details. Return fees are paid entirely by the customer.
8. Refunds and replacements of defective or damaged goods
In the case of defective goods, the same will be returned to Mobilificio Marchese within 7 days from delivery. In this case, the costs of shipping and packaging for the return are borne by Mobilificio Marchese srl. The defective goods will be replaced or refunded if it is not possible to replace it with the same product. Should the customer receive the packages visibly damaged by courier and / or carrier, (broken packaging or visibly damaged) will proceed as follows: - If it is more packages, only reject the damaged package to the sender. We will then take care to contact the customer and arrange replacement and / or refund. - If it is a shipment of a single package, reject the shipment to the sender and as before will then take care to contact the customer and arrange replacement and / or refund. In the case of the damaged product breakdown, the customer will be contacted for a possible replacement by item of equal value and features available or alternatively to reimburse the sums paid.
9. Warranty
The products sold are covered by warranty for any lack of conformity for 24 months (from the date of delivery of the goods), as determined by pursuant to Legislative Decree no. 24/02. In order to activate the warranty, the customer will be able to show proof of purchase. To this purpose it is sufficient to print the email of the confirmation of the order. The guarantee is applicable only with respect to products that present a lack of conformity, provided that the product has been used according to its intended use and any technical specification that the kits. The guarantee is applicable only to the customer "consumer " within the meaning of that legislative decree, that is the person who purchases the goods for purposes not related to his professional activities.
10. Personal Data Protection
Mobilificio Marchese srl holds by law the personal data collected from the moment of registration to the website, as well as those subsequently submitted at the time by the customer, except for the data relating to the payment procedure for which reference should be made to institutions bank through which the transaction occurs. 11. Governing Law
The sale contract between the customer and Mobilificio Marchese srl is concluded in Italy and regulated by Italian law.
12. Jurisdiction
In the event of litigation and in the absence of an amicable settlement reached between the parties, being understood subject to any applicable mandatory provisions of law for the protection of consumers (as defined under article 1 letter b) of Legislative Decree 22 May 1999 n. 185), any dispute related to these Terms and Conditions , will be under the exclusive jurisdiction of the Court of Messina . Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and understood these clauses of the General Conditions of Use: 1-2-3-4-5-6-7-8- 9-10-11-12.
